In these writ petitions, order passed by the School Tribunal condoning delay in filing the appeal under Section 9 of the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977 is under challenge.
In Writ Petition No.1197 of 2018, challenge to similar orders passed on the same day was considered. The contention sought to be raised on behalf of the petitioners that the management was not heard before the order condoning delay was passed has been taken into consideration by observing that since the appeal was filed within a period of thirty days from the disposal of Writ Petition No.2678 of 2015, the order condoning delay did not call for any interference. Hence, for reasons assigned in judgment dated 14.06.2019 in Writ Petition No.1197 of 2018, there is no reason to interfere with the impugned order.
WPs1192&1193-18 The Writ Petitions are therefore dismissed. No costs. JUDGE APTE
