By this application, the appellant is seeking stay to the effect, operation and implementation of the judgment and decree passed in M.A.C.P. No. 192/20102 by the Member, M.A.C.T. Amravati.

Earlier, the stay was granted subject to the condition that the appellant shall deposit the amount within a period of one week. Thereafter, the appellant/insurance company deposited the cheque, but it was in the wrong name, therefore, it was returned back.

Now, the learned advocate for the appellant Mr. G.I. Dipwani submitted that he will receive the new cheque rkn

28caf82.2022.odt within a period of two weeks from Jaipur Office and he will deposit the same forthwith.

In view of that on depositing the compensation amount within a period of three weeks, the implementation and execution of the impugned judgment and award passed by the learned M.A.C.T. Amravati be stayed till disposal of the appeal.

On failure to deposit the compensation amount, the stay granted will be vacated automatically without further reference to the Court.

Civil application No. 82/2022 is disposed of. List the matter on 27/03/2023.
