31st January, 2017 Prayer is to permit the claimants to withdraw the amount of compensation deposited by the appellant. Perused the impugned judgment. It is submitted by the learned counsel for the appellant that the challenge to the impugned judgment is with regard to the finding recorded as to involvement of the offending car.

In the facts of the case, the claimants are permitted to withdraw fifty per cent of the amount of compensation deposited by the appellant, subject to

filing an undertaking that in case the appeal is allowed, said amount shall be repaid with interest at such rate the Court may direct.

Civil Application is disposed of.
