The petitioner whose caste claim is invalidated continues in employment because of interim orders passed in Writ Petition. 2.

This Court has, after giving sufficient opportunity to petitioner, dismissed writ petition for want of prosecution. 3.

Earlier orders passed by this Court on 26th July 2017 and 20th September, 2017 show opportunities given to petitioner. Even on 11.10.2017, similar opportunity has been given to petitioner.

The petitioner is in employment since 1990. 5.

In this situation, though learned AGP is opposing restoration of writ petition, subject to payment of costs of Rs. 5,000/- (rupees five thousand) to the High Court Legal Services

Sub Committee, Nagpur, we restore the petition back to file. 6.

It is made clear that continuation of petitioner in employment shall be at his own risk and costs. 7.

Learned AGP waives notice in writ petition after restoration.

List the writ petition for final hearing on 8.2.2018. If it is not argued on that day, the petition shall stand dismissed automatically without reference to the Court. JUDGE JUDGE sahare
