DECEMBER 01, 2025 CRIMINAL APPLICATION (APPA) NO. 2369 OF 2025 1) Heard learned counsel for the respective parties. 2) This is an application seeking permission to assist the prosecution.
Considering the reasons stated in the application, the same is allowed as prayed.
Accordingly, Criminal Application is disposed of. CRIMINAL APPLICATION (ABA) NO. 802 OF 2025 1) Heard learned counsel for the respective parties. 2) The applicants are apprehending arrest in Crime No.297/2025 registered with Rural Police Station, Washim, Taluka and District Washim for the offence punishable under Sections 108, 115(2), 3(5), 324(4), 333, 351(3), 352 of Bharatiya Nyay Sanhita, 2023.
2 09-aba 802.2025.odt The allegations made against these applicants are that they are neighbours of the family of the deceased and quarrel took place between them. The applicant No.1 Mangla abused in filthy words against the deceased Shradha daughter of the informant. After two months, Shradha had committed suicide. Learned counsel for the applicants stated that there is no nexus of said quarrel and death of the deceased. The only allegation is that the quarrel took place between them and thereafter she had committed suicide. In fact she has committed suicide two months after the incident. Though the offence is registered, custodial interrogation of the applicants are not required.
5) Learned APP opposed stating that specific allegations are levelled against the applicants, due to which deceased Shradha had committed suicide. Therefore, he prayed to reject the present application.
6) Considering the nexus between the incident and the suicide committed by the deceased, it is not the case of the informant that immediately after quarrel, she had committed suicide. As after a period of two months of said quarrel, she had committed suicide, it cannot be said that she had committed suicide due to the said quarrel. Therefore, the custodial interrogation of the applicants are not required. Hence, I proceed to pass following order :-
O R D E R
1) The application is allowed.
2) It is directed that in the event of arrest of the applicants, namely, - (i) Mangla Suresh Thakare and (ii) Roshan Suresh Thakare in connection with Crime
3 09-aba 802.2025.odt No.297/2025 registered with Rural Police Station, Washim, Taluka and District Washim for the offence punishable under Sections 108, 115(2), 3(5), 324(4), 333, 351(3), 352 of Bharatiya Nyay Sanhita, 2023, shall be released on bail on furnishing P.R. Bond in the sum of Rs.20,000/- (Rupees Twenty Thousand) with one solvent surety in the like amount.
As the applicants and the family of the deceased are staying in the same locality, the applicants not to enter in the area where the family of the deceased is staying.
The applicants shall not in any way tamper with the prosecution evidence.
5) The applicants shall not pressurise or threaten the prosecution witnesses.
6) The applicants shall attend the concerned Police Station once in a week between 1.00p.m. to 2.00p.m. till filling of the charge-sheet.
7) The applicants shall co-operate the Investigation Officer.
