1] Heard the learned Counsel for the petitioners. 2] Vide order dated 13.01.2020 passed by this Court (Coram : R. V. Ghuge, J.), cost of Rs.10,000/- was imposed on the two petitioners and the amount was directed to be donated to the High Court Bar Library, Nagpur on or before 31.01.2020 and the receipt of the said deposit was to be produced on record. The Registry was directed to place the matter before this Court on 04.02.2020 for indicating compliance of this order. It is further observed that if the amount is not deposited, the Trial Court could be directed to dismiss the pending suit. 3] Thereafter, the matter was listed on 04.02.2020. On that day, the learned Advocate for the petitioners orally prayed for time to deposit amount of Rs.10,000/-, however, this Court declined to consider oral prayer. Therefore, the learned Advocate for the petitioners prayed for two weeks time to file application for extension of time. Hence, the matter is placed today.
921.WP7792.17.odt 4] The learned Advocate for the petitioners states that though the petitioners were informed vide letter/notice dated 10.02.2020 and the same is received by the petitioners, they have failed to contact and to instruct the learned Advocate for the petitioners.
5] In view of the aforestated facts and in terms of order dated 13.01.2020, the Trial Court is directed to dismiss the Regular Civil Suit No.427 of 2015. 6] Writ Petition is disposed of in above terms.
