DATE : 07/11/2025 1) The applicants have apprehension of arrest in Crime No.245/2025 dated 02.10.2025 for the offence punishable under Sections 118(2), 189(1), 189(2), 189(4), 191(2), 191(3), 190, 115(2), 351(2), 351(3) and 352 of Bharatiya Nyaya Sanhita, 2023 registered by the respondentPolice Station Officer, Police Dist. Station Sonala, Tq. Sangrampur, Buldhana.
2) It is the case of the prosecution that the relatives were chitchatting in the courtyard. The applicants came from another village to attend the Dashera festival. They were chitchatting. The dispute arose between both of them. Parmeshwar Chavhan abused them and he took the spade
2 / 3 15-aba 805-25 from his house and assaulted on the head of Sagar. The allegations made against these applicants are that they also beat the injured with fists and blows. The learned counsel for the applicants has stated that the applicants are relatives of the accused no.1. As per FIR the role played by these applicants are of slapping the injured. Considering the role played by these applicants, prayed to protect the applicants by granting anticipatory bail.
3) The learned APP opposed the application stating that in the FIR name of these applicants are mentioned. They were present on the spot. The role attributed to them is that they also beat the complainant by fists and blows. The custodial interrogation is necessary. Hence prayed to reject the application.
4) Heard both the sides.
5) All the accused persons are family members. During chitchat the quarrel took place and one of them assaulted with spade. Considering the role played by these applicants that they slapped the injured, custodial interrogation of these applicants is not required. Hence, the application is allowed. Accordingly, I pass following order: i] In the event of arrest of the applicantsIndirabai Bhagwan Shinde and Fulabai Shankar Shinde, in connection with Crime No.245/2025
3 / 3 15-aba 805-25 dated 02.10.2025 for the offences punishable under Sections 118(2), 189(1), 189(2), 189(4), 191(2), 191(3), 190, 115(2), 351(2), 351(3) and 352 of Bharatiya Nyaya Sanhita, 2023 registered by the respondent-Police Station Officer, Police Dist. Station Sonala, Tq. Sangrampur, Buldhana, they shall be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Thousand each with one solvent surety each in the like amount.
ii] The applicants shall not in any way tamper with the prosecution evidence.
iii] The applicants shall not pressurize or threaten the prosecution witnesses.
iv] The applicants shall attend the concerned police station on every Monday and Saturday between 7:00 p.m. and 9:00 p.m.
v] The applicants shall co-operate the investigation officer.
6) Application stands disposed of.
