Shri Mirza, learned Additional Public Prosecutor for respondent, has pointed out that challenge in this appeal is to judgment and order passed by learned Assistant Sessions Judge, Nagpur in Sessions Trial No. 239/2016 and as such, said judgment is appealable before learned Sessions Court, Nagpur. Shri Upadhyay, learned Counsel for appellant, has not disputed said fact and in the circumstances, seeks leave to transfer this appeal to learned Sessions Court, Nagpur.
It appears that this Office inadvertently registered the appeal wherein on issuing notice, same came to be admitted on 19/1/2017 and sentence imposed upon appellant/original accused no.2 Sau. Megha alias Durga Bhojraj Pende came to be

In view of the admitted fact that appeal would lie before Sessions Court, Nagpur, leave as prayed is granted.
Registry to take necessary steps and shall transfer present appeal for being placed before competent Court at Nagpur.
