With the assistance of learned Counsel for the petitioners so also the Additional Government Pleader Ms Jachak appearing for respondent No.1, we have perused the communication dated 02.08.2022 and 18.01.2023 whereby the name of the petitioner No.1 is removed from the waiting list as a candidate eligible for grant of compassionate appointment. Similarly, the substitution is refused vide communication dated 18.01.2023.

We are of the view that such communication, prima facie, goes contrary to the mandate provided in Full Bench Judgment in the case of Kalpana wd/o. Vilas Taram and Anr. Vs. State of Maharashtra and Ors. reported in 2024 (4) Mh.L.J. 312.

That being so, we direct the petitioners to appear before the Chief Executive Officer, Zilla Parishad, Bhandara on 03.02.2025 along with the copy of petition with annexures and the copy of the aforesaid judgment.

We direct the Chief Executive Officer, Zilla Parishad, Bhandara, if so requires to hear the petitioners and pass afresh order in the matter in the light of law laid down in the judgment of the Kalpana wd/o. Vilas Taram (cited supra).

Let the order be communicated to the petitioners by 28.02.2025.
