Husband and Wife i.e. parties to matrimonial discord have filed this proceedings jointly through separate Advocates. They point out that before the Coordinator, Family Court at Nagpur compromise has been entered into on 07.11.2016. H.M.P. No. A-76/2015 is still pending before the Family Court. As a part of that compromise, the Criminal proceedings lodged by the applicant no.2 are to be withdrawn.

Parties are identified by their respective Advocates. Applicant no.2 Sou. Vijaya accepts the fact of compromise and terms thereof.

It appears that she is still to receive the amount of Rs. 3 lakhs and the marriage is still to be dissolved.

In this situation, as jointly requested, we make Rule absolute in terms of prayer clauses (A) and (A1). Writ Petition is allowed and disposed of. No costs.
