The applicant has apprehension of arrest in crime No. 530 of 20025 for the offences punishable under Sections 120-B, 166, 182, 201, 212, 218, 409, 468 and 471 of the Indian Penal Code.

The complainant Narendra Sharma has alleged that at the relevant time (01.01.2021 to 01.08.2025), the applicant was working as a Chairman of the Construction Committee, Nagar Parishad, Kamptee. The applicant is the accused 4. According to said Narendra Sharma, while the accused persons were in charge of Nagar Parishad, Kamptee and have constructed various cement roads, paving blocks, etc. However, while floating the tenders for the said

2 / 3 13-aba-807-25 construction works, the accused persons have ensured that the tenders shall be allotted to M/s Paras Enterprises, by hatching a criminal conspiracy. Said M/s Paras Enterprises is closely related with the accused 2. Due to the said conspiracy, 80% of the construction work was allotted to the said M/s Paras Enterprises. The company has not completed any construction work and despite this, has collected the contract amount and to the said end, have prepared forged bills and other relevant documents and caused a huge financial loss to the state exchequer. The crime is registered on the Private complaint lodged by Said Narendra Sharma. 4.

The learned APP has stated that there is documentary proof that the husband of this applicant has taken the amount from said M/s Paras Enterprises and has committed the crime of misappropriation.

5. Heard both the sides and perused the record.

6. As the other co-accused against whom the similar allegations are made are already protected by granting anticipatory bail by this Court. Considering the allegations made against this applicant, the custodial interrogation is not required. Hence, the applicant is protected by granting anticipatory bail. Hence, the following order:-

3 / 3 13-aba-807-25 i] It is directed that in the event of arrest of the applicant- Rama Nagsen Gajbhiye in connection with Crime No. 530 of 20025 registered with Police Station Old Kamptee district Nagpur for the offence punishable under Sections 120-B, 166, 182, 201, 212, 218, 409, 468 and 471 of the Indian Penal Code, he be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand with one surety in the like amount.

ii] The applicant shall not in any way tamper with the prosecution evidence.

iii] The applicant shall not pressurize or threaten the prosecution witnesses.

iv] The applicant shall attend the concerned police station as and when called by the Investigating Officer. v] The applicant shall co-operate the investigating officer.
