Heard Shri M. Anilkumar, learned counsel for the petitioner, Shri M.J. Khan, learned AGP for respondent Nos. 1 & 2 and Shri A.P. Thakare, learned counsel for respondent No. 3.
It is stated by the learned counsel for the petitioner that the issue involved in this petition has been addressed by respondent No. 2, after necessary correction in the date of birth mentioned in the Board Certificate has been made by the Maharashtra State Secondary and Higher Secondary Board and, therefore, now the grievance does not survive, although for taking redressal of the same, the petitioner has suffered a lot as she was made to move from pillar to post. He submits that this factor may be considered by this Court while deciding the question of imposition of cost appropriately.
As regards the question of imposition of cost, having considered the facts and circumstances of the case in
2101cp311.18 their entirety, we are not inclined to accept the submissions about the same. The issue has also been resolved and, therefore, the contempt, if any was there, has been purged. Hence, this Contempt Petition does not survive and it needs to be disposed of as such. It is disposed of accordingly.
