The order dated 18.09.2025 passed by the Family Court, Amravati has been challenged in this petition, wherein granting of maintenance pendente lite amounting to 2000/- to the respondent for attending the proceedings ₹ before the Family Court was upheld.

The contention of the petitioner is that the respondent herself is residing at Amravati where the proceedings are pending therefore, the order of granting 2000/- as maintenance pendente lite towards ₹ transportation is bad in law.

Another contention is that the parents of the respondent was residing at Nagpur and now they are no more and earlier proceeding filed by the respondent against the petitioner is at Amravati therefore, the impugned order of transportation allowance of 2000/- should not have been ₹ passed.

Compilation of writ petition depicts the affidavit of examination-in-chief at page 24 which reveals that the respondent has shown her address as Indora, Nagpur. It may be possible that her sister resided at Amravati therefore, at some places she has written her address as " Care of " showing the address of her sister that does not mean she permanently resides at Amravati. More so, the impugned order is very clear that whenever the respondent will actually attend the proceedings then only the petitioner will be liable to pay amount of 2000/-. Hence, no interference ₹ is required in the impugned order. Consequently, the writ petition stands dismissed. No order as to costs. (M.W. Chandwani, J.) Wagh
