The reason for rejection of prayer for parole is the earlier conduct of the petitioner has led to registration of N.C. Crime No.973/2021 under Section 506 of the Indian Penal Code.

Apart from above, it is also observed that in view of ensuing Legislative Assembly elections at that time, the petitioner's prayer came to be rejected.

As far as reasons cited are concerned, it is brought to our notice that by orders dated 01/02/2023 and 11/07/2024 the petitioner was already released on parole. As such, the antecedents as has been claimed were not considered as a bar while passing the earlier orders granting parole. 5.
Apart from above, the Assembly elections are already over. 6.
In this background we deem it appropriate to quash and set aside the impugned order dated 21/10/2024.

The petitioner be admitted to parole on reasonable conditions in accordance with the Rules.

Let the order passed be communicated to the petitioner within a period of two weeks from today.
