The applicant/Insurance Company has filed this application for condonation of delay of 500 days in filing the appeal against the Judgment and order dated 06.02.2023 in M.A.C.P. No.77 of 2016.

Though the application is strongly opposed by the learned Counsel for the respondent nos.1 to 3/Claimants and respondent no.5/Owner however considering the reasons stated in the application and in the interest of justice, the application stands allowed and the delay is hereby condoned.

The application is disposed of.

The appeal be registered on removal of all the office objections, if any.

The learned Counsel for the respondent nos.1 to 3/Claimants and the learned Counsel for the respondent no.5/Owner waive service in the main appeal, on its

The application is filed for permission to deposit of decreetal amount of Rs.92,10,917/-.

There is no objection from the side of respondents.

As such, the application stands allowed and the applicant/Insurance Company is permitted to deposit the decreetal amount as mentioned above through the cheque, within a week.
