On instructions, learned Counsel for respondent No. 1 has made a statement across the bar that if a new application is made by the petitioner for making donations under the head of corporate social responsibility in terms of the provisions of the Companies Act, 2013 together with all the requisite documents including the latest No Objection Certificate issued by the concerned municipality, same shall be considered by the respondents in accordance with law and subject to approval of the competent authority.

Learned counsel for the petitioner submits that the petitioner is willing to make an application afresh on the lines stated by the learned counsel for the respondents.

In view of above, we are of the view that the issue involved in the petition no longer survives for consideration and as such, petition deserves to be disposed of accordingly.

If any application afresh is made on the lines suggested by the learned counsel for the respondent No. 1, same shall be considered in accordance with law, subject to approval of the competent authority, in the concerned financial year.

The petition is disposed of in above terms. No costs.
