The applicant - Jyoti Vare is seeking transfer of HMP No. 653 of 2019 filed by the respondent - husband, which is pending on the file of 8th Joint Civil Judge, Senior Division, Sangali to Family Court, Nagpur.

It is stated that the applicant is 78% disable and she cannot walk and, therefore, cannot attend the proceedings at Sangali. The applicant has filed a disability certificate in support of her contention.

Inspite of due service of notice to the respondent, the respondent preferred, not to appear before this Court.

Considering the reasons mentioned in the application, case for transfer of HMP No. 653 of 2019 is made out. In the circumstances, application is allowed in terms of prayer clause (i).
