Heard learned counsel Shri A.D. Hazare for the applicant and learned Additional Public Prosecutor Shri Amit Madiwale for the State.

The applicant is apprehending his arrest in connection with POR No.103/2 registered with Range Forest Officer, Forest Division, Bramhapuri (Sub Area Chimur), district Chandrapur for the offences punishable under Sections 9, 39(1) and 51 of the Wild Life (Protection) Act, 1972. 3.

According to the prosecution, the Range Forest Officer received an information that body of a tiger is lying in the field of the son of the present applicant. The forest officials, thereafter, visited the spot and they noticed that electric current was supplied to the fence, with the result, an .....2/-

aba869.17 12 unfortunate animal met with its tragic death. Thereafter, the present applicant tried to burn the tiger in order to destroy the evidence.

According to learned counsel for the applicant, the applicant is an innocent. He is aged about 74 years and the agricultural field belongs to his son.

It is to be noted that recently there is a spurt in this area of killing the tigers by adopting various modes in order to gain money illegally. The attitude of such persons has to be dealt with severely and with an iron hands in order to save environment.

Learned Additional Public Prosecutor points out from the case diary that there is sufficient material against the present applicant.

Consequently, the criminal application is rejected and disposed of.
