This is an application for relaxation of condition and modification of the condition imposed on him. By order dated 14/11/2024, the applicant was directed to stay out of the Nagpur District and shall enter into the Nagpur only for the purpose of attending the proceedings before the Sessions Court, Nagpur.

Learned counsel for the applicant submitted that the applicant is the Government servant, and he has to attend to his duty, though he is suspended.

Learned APP strongly opposed the said application and submitted that there is a likelihood of tampering of the witnesses.

After hearing both sides and on perusal of the application as well as the order passed by this Court. The condition was imposed only due to the apprehension of the rkn
8appp2168.2024.odt prosecution of tampering of the witnesses. Considering now the investigation is already completed and chargesheet is filed. 5.
Considering that the applicant is a Government Servant and the condition imposed on him by clause (iii) by order dated 14/11/2024 that he shall stay out of Nagpur District and shall enter into Nagpur only for the purpose of attending the proceedings before the Sessions Court is hereby cancelled, subject to the condition that the applicant shall not induce, threat or promise any witnesses who are acquainted with the facts of the case, and also a single breach on his part would lead to cancellation of bail. 6.
The Criminal Application (APPP) No. 2168 of 2024 is disposed of.
