DATED : AUGUST 26, 2019 The learned counsel for the parties informed this Court that the dispute between them has been settled. The dispute was settled between the parties before the National Lokadalat at Buldhana. It is informed that in pursuance of the said settlement of dispute, the appellant insurance company deposited the entire amount before the Executing Court. According to the learned counsel for the appellant insurance company, the amount was withdrawn by the respondents claimants. The learned counsel for the claimants does not have clear instructions as to whether the amount was withdrawn. Nonetheless, the fact that the dispute was settled between the parties is not disputed. In this backdrop, the learned counsel for the appellant insurance company seeks permission to withdraw the present appeal with prayer that the decreetal amount deposited in this Court along with
2 fa964.18.odt statutory deposit and Court fees be refunded to the appellant.

In view of the aforesaid developments, the present appeal is disposed of as withdrawn. The appellant is permitted to withdraw the decreetal amount, statutory amount and Court fees deposited in this Court.

The respondents (claimants) are permitted to withdraw the amount deposited in the Executing Court by the appellant insurance company, if not already withdrawn.

Appeal is disposed of.
