In the present writ petition, the order dated 31.08.2023 passed by the Jt. Civil Judge (Sr. Dn.) Pusad, Dist. Yavatmal in HMP No.187 of 2019, is under challenge whereby, the petitioner was directed to clear the past arrears of maintenance amount within the period of three months and continue to deposit the monthly maintenance amount regularly.

It is further observed that, if the said direction are not followed or not complied by the petitioner, then the petition for divorce will be disposed off considering his default under Order 39 Rule 11 of the Code of Civil Procedure.

The period of three months was lapsed on 01.12.2023 and the petition was filed on 07.12.2023, after lapse of period of three months. In the circumstances, considering the delay and latches, the writ petition is dismissed.
