Present application is filed by the applicantappellant for condonation of delay in filing the first appeal. The delay is of 25 days.

Learned counsel for the appellant submits that due to administrative procedures the delay is caused. 3.
I am satisfied that there is no intentional and willful delay and the reasons are justified. Accordingly, the application is allowed. The delay of 25 days in filing the first appeal is hereby condoned. Registry is directed to register the first appeal.

Civil Application is allowed and disposed of. Civil Application (CAF) No.975/2021 Present application is filed by the applicantsrespondent nos.1 to 3 for grant of permission to withdraw the amount deposited in the office of the Commissioner.

For the reasons stated in the application, it would be appropriate to allow the respondent no.1 for herself and on behalf of respondent nos.2 and 3 to withdraw the fifty percent amount deposited in the office of the Commissioner.

The office of the Commissioner is directed to disburse the amount of fifty percent of total decreetal amount in favour of respondent no.1 and after the amount is deposited in the account of respondent no.1, she shall invest Rs.50,000/- each in the name of respondent nos.2 and 3 in any nationalized bank till they attain the age of majority.

Application stands disposed of.
