The appellant and the respondents/original claimants have filed joint Pursis (St.) No.4/2023 stating that the matter has been amicably settled between the present appellant-Insurance company and respondent No.1-claimant.

The claimant agreed to receive the amount of compensation of Rs.12,73,304/- toward full and final settlement inclusive of no fault liability, costs and interest. 4.

The appellant-Insurance Company has already deposited the decretal amount of Rs.14,23,304/- before the Labour Court, Nagpur.

In view of settlement, respondent No.1 is entitled to receive the amount of Rs.12,73,304/- with accrued interest and the balance amount is to be refunded to the appellant-Insurance Company.

I have personally interacted with respondent No.1 - claimant. He accepted the terms of compromise.

In view of compromise, the appeal is to be disposed of. Hence, the appeal is disposed of accordingly. 8.

Out of the compensation amount which is deposited by the appellant, the amount of Rs.1,50,000/- is to be refunded back to the appellant-Insurance company. 9.

Respondent No.1 is at liberty to withdraw the balance amount of compensation along with accrued interest.

The cross-appeal i.e. First Appeal No.67/2021 is also disposed of in view of settlement.

11.

The amount be disbursed on due identification and verification.
