We have passed the following order on 03.08.2022:
Perusal of the affidavit in response on behalf of the Collector, Nagpur and the Sub Divisional Officer, Katol reveals that the land acquisition proceedings were initiated in the year 1989 and except the petitioner, all other land owners are paid compensation. It is further stated in the affidavit that compensation is not paid to the petitioner due to inter se dispute amongst the trustees.

In view of the affidavit, we direct respondent 3 and 5 to deposit the compensation, without prejudice to rights of the parties in the office of the Joint Charity Commissioner, Nagpur within the next fifteen weeks.

The Joint Charity Commissioner, Nagpur shall invest the amount of compensation in fixed deposit in any
wp8294.19.O.odt nationalized bank. The amount of compensation shall be disbursed by the Joint Charity Commissioner, Nagpur, after making an appropriate enquiry to ascertain the legitimate recipients.

Stand over to 24-8-2022.

The learned counsel for the petitioner Mr. Sonare and the learned AGP Ms. Khan state that the arrangement made and the directions issued supra can be made absolute and the petition can be disposed of in the aforestated terms. 3.
We dispose of the petition in terms of the order dated 03.08.2022 which is extracted supra.
