Former Vice President of Municipal Council, Kamptee has approached this Court praying for grant of anticipatory bail in connection with Crime No. 530/2025 dated 10.10.2025 with Police Station, Old Kamptee for the offences punishable under Sections 120-B, 166, 182, 201, 212, 218, 409, 468 and 471 of the Indian Penal Code.

Mr. Deo, learned counsel for the applicant has invited my attention to order dated 28.10.2025 passed in Anticipatory Bail Application No.810/2025 and 809/2025, by which the Former President of Municipal Council and the former Chief Officer of Municipal Council were protected. He submits that the role of the present applicant is

2 / 3 13-A aba 815-25 somewhat similar to the President and Chief Officer to whom already ad-interim bail is granted.

Learned APP has opposed the application stating that though it is out of private complaint and the report is there to verify what type of offence is committed by these applicants, custodial interrogation of these applicants is necessary. The learned counsel assisting to the prosecution has also opposed the application as prima facie case is made out against these applicants. Considering the arguments made by the learned APP and the learned counsel assisting to the prosecution, only because the crime is registered, the custodial interrogation is not necessary. Hence, the adinterim protection granted on 31/10/2025 needs to be confirmed on the same terms and conditions. Hence the following order:- i] The application is allowed.

ii] The order dated 31/10/2025 granting adinterim anticipatory bail is confirmed on the same terms and conditions.

iii] The applicant shall attend the concerned police station as and when called by the investigating officer. iv] The application stands disposed of.
