This is the successive bail application on the part of the applicant. The first application of the applicant was filed as Criminal Application (BA) No. 938 of 2019 and after hearing Mr. Ghare, learned counsel appearing in the said application, when the Court was about to dismiss the application, then learned counsel withdrew the application and therefore this Court observed on 22.10.2019 that the Court is not detailing reasons for its dismissal. Mr. Gahlot, learned counsel for the applicant submits that there is change in circumstance in the matter. According to him the change in circumstance is that husband of the applicant has diagnosed with Cancer. In my view, that cannot be a change in circumstance. That has nothing to do with merits of matter.

Even when this Court was about to dismiss the matter on its own merit considering the entire material

ba1157.19.odt against the applicant in the charge-sheet, Mr. R.V. Ghalot, learned counsel for the applicant submits that he has instructions to withdraw the application.

The application is dismissed as withdrawn.

Since the learned counsel for applicant is withdrawing the application, the Court is not detailing the entire prosecution case against the applicant. JUDGE srwagh
