After hearing learned counsel for the parties and after perusing the reply filed on behalf of non-applicant No.2, when the Court was about to dismiss the application, learned counsel Shri S.V. Sirpurkar for the applicant submitted that he wishes to withdraw the present applicant. He submitted that liberty be granted to the applicant for challenging proceedings of Criminal Case No.382/2012 pending on the file of learned Chief Judicial Magistrate, Court No.5 at Akola. 3.

The applicant is permitted to withdraw the present application challenging order passed by learned 4 th Judicial Magistrate First Class at Akola dated 20.12.2011 by which learned Magistrate .....2/-

apl836.17 12 accepted B-Summary which is confirmed by the Revisional Court vide judgment dated 16.10.2017 in Criminal Revision No.91/2016. 4.

The criminal revision application is dismissed as withdrawn with liberty to the applicant to take appropriate steps in respect of Criminal Case No.382/2012 pending on the file of learned Chief Judicial Magistrate, Court No.5 at Akola in accordance with law. JUDGE !! BRW !!
