Heard Shri A.M. Ghare, learned counsel for the applicant/ petitioner and Ms. N.P. Mehta, learned AGP for respondent Nos. 1 to 3.

Writ Petition No. 5766 of 2016 is partly allowed on 02.07.2018. The elected Board of Directors of the applicant - APMC was restored/ continued with a rider that they will not take any major policy or financial decision. 3.

The Hindustan Petroleum Corporation Limited (HPCL) has proposed opening of a retail outlet in the yard of APMC and for that purpose necessary clearances are issued by the office of Respondent Nos. 2 & 3. The APMC has to execute a lease of 30 years in favour of HPCL as part of said proposal.

In this situation, as action being taken is in the interest of APMC and the agriculturists visiting the Market yard, we permit the APMC to execute and register such

0211caw2839.18 agreement on suitable terms. The payments received shall be through cheque, DD and deposited in the Bank Account of APMC.

Civil Application is accordingly allowed and disposed of. No order as to costs.
