Heard learned counsel for the appellant and learned A.G.P. Shri Dubey for the State.

On going through the explanation given in the application, one thing that emerges is that, the applicant has been making his efforts i the direction of filing of an appeal, but his efforts could not produce desired result because of the circumstances not really within his control. This would also show absence of malafides on the part of the applicant. Therefore, I am of the view that this application would deserve acceptance.

The application is allowed. Delay is condoned. Appeal be registered.
