The applicant is assailing the order by and under which the application for rejection of plaint preferred under Order 7, Rule 11 of the Code of Civil Procedure is rejected. 2] The application is substantially, if not entirely predicated on the assertion that the valuation done as is not correct and that insufficient court fees are paid. 3] Shri Akshaya Naik, on instructions, from applicant 2 who is present in Court, seeks leave to withdraw the application with liberty to raise the issue as regards the valuation and payment of court fees in appropriate proceedings.

4] The applicant is permitted to withdraw the application with liberty as prayed.
