MARCH 3, 2025 On 13/1/2025, following order was passed :
"The learned Counsel for the petitioner seeks permission to delete respondent nos. 3 and 4.
2] Permission is granted. Necessary amendment be carried out forthwith.
3] One of the reasons why the petitioner was not provided information under the Right to Information Act, 2005, is that the information could be obtained from the office of the Charity Commissioner, and since effective remedy is available, the same ought to have been exhausted.
4] The petitioner, without approaching the office of the Charity Commissioner, appears to have approached respondent no.1 for information.
The State Information Commissioner, Maharashtra, has observed that there are judgments of the Gujarat High Court and other Courts on this point. The petitioner, however, has not disclosed in the petition that he had either approached the office of the Charity Commissioner or has inspected the record before approaching respondent no.1.
5] The learned Counsel for the petitioner seeks time to have research on this point.
6] Time is granted. List in the week commencing from 27/1/2025."
11-WP-12-2025 2] As could be seen, the learned Counsel for the petitioner sought time to have research on the point mentioned in the order. Accordingly, the matter was listed on 10/2/2025 when the learned Counsel sought further time to have research on the point. The request was accepted but as a last chance.
3] Today is yet another day when Mr. R.R. Gupta instructed by Ms G.K. Sharma, learned Counsel for the petitioner, seeks further time to have research. He mentioned the matter in the morning but adjournment was not granted on the count that last chance was given on previous date. When the matter was called, the petitioner in-person along with Mr. R.R. Gupta, learned Counsel, is present. The petitioner in-person is now seeking adjournment on the count that some documents are to be placed on record.
4] Adjournment is granted subject to cost of Rs.25,000/- to be deposited with the High Court Bar Association Library, Nagpur, within seven working days from today. If the cost is not deposited within seven working days, the petition shall stand dismissed for noncompliance of order. 5] If cost is deposited, list thereafter.
