06th December, 2017 The present proceedings filed under Section 482 of Criminal Procedure Code, 1973, raise a challenge to the order issuing Process in the complaint filed by nonapplicant no.2 alleging commission of offence under Sections 499 and 500 of the Indian Penal Code. This Court admitted the Application vide Order dated 22nd June, 2017. During pendency of the proceedings, Criminal Application No. 2025 of 2017 has been filed in which it is stated that the applicant and non-applicant no.2 have compromised the proceedings and the offence in that regard be compounded. It is also prayed that in view of the disputes having come to an end, the proceedings be quashed. This application is
signed by the original complainant - non-applicant no.2 as well as his learned counsel.
Perused the complaint as well as the joint application filed by the complainant as well as accused. Considering the statements made in this application that it is on account of some misunderstanding that led to filing of that complaint and the further fact that complainant does not desire to further prosecute the criminal proceedings, I do not find any difficulty in accepting the prayer as made. There does not appear to be any element of public law involved and the offence is with regard to alleged defamation of the complainant.
In view of aforesaid, the application stands allowed. The proceedings in Criminal Complaint Case No. 3384 of 2014 that is pending before the learned Judicial Magistrate First Class, Court No.6 at Nagpur, stand quashed.
Application is allowed in aforesaid terms.
Hamdast is granted.
