I have heard Mr. S. K. Bhoyar, learned counsel for the applicant and also perused the reply filed on behalf of the non applicant. After hearing learned counsel for the applicant and after going through the application as well as the reply, I am of the view that the delay of 83 days needs to be condoned.

In that view of the matter, the application is allowed. Delay of 83 days is condoned. The application is disposed of.
