Heard with the consent of learned counsel for the parties.

The petitioner has filed this petition seeking direction to the respondents to grant pensionary benefits which have been denied to him.

Learned counsel for the parties jointly submit that the controversy involved in this petition is squarely covered by an order dated 13.11.2024 passed in Writ Petition No.637 of 2022.

In view of aforesaid submission and for the reasons assigned in the said order by the Division Bench of this Court, the communication dated 30.08.2024 is quashed and set aside. 5.

It is directed that the petitioner shall not be treated to be disqualified for retirement benefits on the ground that he has not cleared NET/SET qualification in view of the order of UGC granting exemption dated 05.11.2008. The petitioner is held entitled to the consequential benefits on his retirement.

The respondent No.3 - Principal, Shantaram Potdukhe College of Law, Chandrapur, is directed to forward the pension papers of the petitioner to the State Government and the State Government shall accordingly release the petitioner's pensionary benifits.

The aforesaid exercise shall be carried out by the respondents within a period of four months from the date of production of copy of this order.
