DATE: 16 th DECEMBER, 2019.
Civil Application (CAW) No.3336/2019:
Heard.
While allowing the petition in terms of prayer clauses A and B, this Court did not specify the time frame within which the notification regarding lapsing of reservation was to be issued by respondent no.1. However, we had followed the view taken by coordinate Bench of this Court in Pratap Tularam Ghogale & Ors. v. The State of Maharashtra & Ors. reported in 2013(5) ALL MR 1, in which, time of three months was granted to the authority for doing a similar act i.e. issuance of notification of the lapsing of reservation. Therefore, even though no time frame has been fixed in this matter.
generally speaking, same time period, as is mentioned in Pratap Tularam Ghogale'
s case (supra), would govern the issue involved in this petition.
The application is disposed of accordingly.
