Leave, to convert this Criminal Writ Petition into Criminal Application (ABA) for transit anticipatory bail under Section 438 of the Criminal Procedure Code, is granted and accordingly this matter be registered as Criminal Application (ABA) under Section 438 of the Criminal Procedure Code.
Having heard learned counsel for the applicants and having gone through the allegations made in the F.I.R., I am of the view that the interim protection could be granted to the applicants by way of transit anticipatory bail in order to enable them to approach appropriate Court in the State of Haryana for seeking appropriate relief.
Accordingly, this application is granted and it is directed that in the event of arrest of the applicant in Crime No.328/2016, registered with Police Station Barwala, Distt. Hissar, for the offences punishable under Sections 294,406 and 420 of the Indian Penal Code, the
Sunil Hitech Engineers Ltd. vs.State of Haryana and antoher.odt 2/2 applicants be released on bail on each of them furnishing a P.R. Bond in the sum of Rs.25,000/- together with one solvent surety.
This order shall remain valid only till 16th January, 2017 and that the applicant shall co-operate with Barwala Police in making the investigation.
