These counter applications are filed by the wife and husband under Section 24 of the Code of Civil Procedure seeking transfer of the marriage petitions filed by the other side. Both the petitions, one filed at Mumbai and another at Amravati are at preliminary stage and written statements are not yet filed in both the matters.

Considering the nature of the proceedings, I find that the request made in these applications for transfer of proceedings is premature. Granting liberty to the parties to move application at appropriate stage of the proceedings, these applications are dismissed. The parties to bear their own costs.

The learned advocates for both the parties pray that personal appearance of the party in each proceedings may be dispensed with.

The parties are granted liberty to make this request before the trial Court and if such request is made, the trial Court shall consider it pragmatically.
