The applicant is apprehending his arrest in connection with Crime No.383/2017 registered with Police Station, Padoli, Chandrapur for an offence punishable under Sections 65 (e) and 83 of the Maharashtra Prohibition Act and under Section 188 of the Indian Penal Code.

The prosecution case is that Police Constable Sandeep got a secret information and therefore a raid was conducted at mouza Kanda Layout, Padoli, ChandrapurNagpur highway. That time, they found one motor vehicle bearing registration No. MH-20/CH-4320 coming towards Padoli. According to the prosecution, on noticing the police party, the driver of the vehicle stopped the vehicle 100 meters before the check-post. The vehicle was seized wherein liquor was found to be stored.

The applicant is driver of the said vehicle. It is not the case of the prosecution that the applicant is owner of the said contraband. Further, there is no criminal antecedents of the present applicant.

In that view of the matter, I am of the view that the applicant can be released on anticipatory bail on imposing certain conditions.
Hence, following order is passed.
ORDER
(i) Criminal Application No. 874/2017 is allowed. (ii) The applicant-Roshan Dhansing Chawhan, in the event of arrest in connection with Crime No.383/2017 registered with Police Station, Padoli, Chandrapur for an offence punishable under Sections 65 (e) and 83 of the Maharashtra Prohibition Act and under Section 188 of the Indian Penal Code, be released on bail on he executing P.R. Bond in the sum of Rs.25,000/- with two solvent sureties in the like amount.
(iii) For the first 11⁄2 months, the applicant shall attend Police Station, Padoli, Chandrapur twice a week on every Monday and Saturday and shall be with the investigating officer between 11.00 a.m. to 05.00 p.m. and thereafter once in a month i.e. on the last Sunday of every month till filing of the charge-sheet.
The application stands disposed of.
