DATE : 06-10-2025 The applicant has moved this application for relaxation in the bail condition granted on 06-06-2023 while suspending the sentence of the appellant during pendency of the appeal. One of the conditions while granting bail was that the applicant shall attend the trial Court Akola once in a month on the first day of every month and the trial Court Akola shall record his attendance before it.

The learned Advocate for the appellant submitted that the applicant/appellant has been regularly attending the trial Court at Akola and the trial Court Akola has record his attendance, but due to his parents' old age, who are suffering from ill-health, makes it impossible for him to attend the Court at Akola which is at 240 km. from its residence. The applicant is a resident of Amalner, District Jalgaon. The learned Additional Public Prosecutor submits that taking into consideration the

2 appp-1946.23 contents of the application, the applicant may be directed to attend police station near his residence.

In view of the same, clause (b) of the terms and conditions of the order dated 06-06-2023 is relaxed. The applicant shall attend the Police Station Amalner, District Jalgaon on the first day of every month and the Police Station shall record his attendance before it.

The application stands allowed accordingly and same is disposed of.
