Civil Application (CAW) No.3313/2019:
Shri Mohgaonkar, learned counsel for respondents seeks further time to file reply in the matter. Shri Mohokar, learned counsel for the petitioners submits that if further time is granted, Civil Application (CAW) No.3313/2019 may be allowed. As there is insistence upon consideration of grant of interim stay, as sought in the said civil application, we have granted hearing to learned counsel for the petitioner.
Upon going through the select list and wait list (Pg.59) and also the list of eligible candidates (Pg.65), we find that the meritorious candidates have been prima facie wrongly ignored and we find that prima facie, even the wait list has been wrongly prepared. Our impression is that those candidates who ought to have been found place in the select list, have been listed in the wait list. The irregularity, prima
wp6174.18.O.odt facie, is manifest on record and therefore, we grant interim stay to the effect and operation to the advertisement No.8/2019 dated 28.11.2019, in respect of the post of Senior Chemist. We direct that until further order, three posts of Senior Chemist, out of the 19 post advertised vide advertisement No.8/2019 shall not be filled up. Application is disposed of.
