Perused the judgment of the learned Trial Court. It appears that the learned Trial Court has not properly appreciated the document (Exhibit No.43), while dismissing the complaint and acquitting the respondent no. 1. In that view, the applicant/appellant has made out a case for grant of leave to file appeal.

The applicant/appellant is therefore, granted special leave to challenge the judgment of acquittal in Summary Criminal Case No. 597/2015. 4.

The criminal application is allowed accordingly.
