The learned Counsel for the respondent No.2, on instructions, states that the entire tender process shall be abandoned and withdrawn and fresh tender shall be issued.

In view of the aforesaid statement made by the learned Counsel on instructions, the claim made in the petition no more survives.

That being so, the petition stands disposed of. 4.

The petitioner if so aggrieved, is at liberty to approach afresh.
