In the present matter, a prayer is made to the effect that respondent No.1. University be directed to hold special examination of petitioners Nos 1 to 39, who have failed in 3rd and 4th semesters and petitioner Nos. 40 to 51, who have failed in 1st and 2nd semesters of B.Pharm course.

Learned counsel for respondent No.1 Mr. R.D. Bhuibhar, points out that without approaching to the University first and making such request to the University, the petitioners have approached directly this Court by filing present petition. He submits that if such application had been made to respondent No.1 University by the petitioners, respondent No.1 would have decided the same by considering the request of the petitions. We find substance in the submission of learned counsel Mr. Bhuibhar.

In light of such submission, we are of the opinion that purpose would be served if present petition is disposed of with direction to respondent No.1 University to treat the present petition as a Belkhede, PS

2 908wp6748.2025..doc representation of the petitioners and place the same before the competent authority to take appropriate decision as regards holding special examination of the petitioners.

Accordingly, we dispose of the petition with direction to respondent No.1. to treat present petition as representation made by the petitioners to respondent No.1 and place the same before competent authority for decision as regards prayer of the petitioners to hold special examination.

Such exercise shall be completed by respondent No.1 by 01.12.2025 and decision be communicated to the petitioners by 02.12.2025.

Mr. Bhuibhar, learned counsel for respondent No.1 University undertakes to communicate this order to respondent No.1 University. Petition is disposed of in above terms.
