The applicant has apprehension of arrest in Crime No.142/2024 registered with Police Station Chamorshi, District Gadchiroli for the offences punishable under Sections 65(a), 98 and 83 of the Maharashtra Prohibition Act, 1949.

On 08.05.2024, the Police Officer has received a secret information that one Scorpio is passing through said way containing illicit liquor bottles. The raid was conducted and it is alleged that the said Scorpio was parked behind Chamorshi Agricultural Produce Market Committee and two persons were standing near the car. They fled from the spot after noticing the police officials approaching the car. The complainant and the team searched the car and found illicit liquor bottles. The First Information Report has been registered.

The learned Counsel for the applicant has stated that the allegations are made against this applicant that he is the owner of the said vehicle. Earlier two First Information Reports are registered against this applicant. Said antecedents were not disclosed and therefore, the

2 10.aba.823.25 applicant has filed an affidavit on record that inadvertently, said antecedents were not disclosed by this applicant. The applicant was not present on the spot. Only because his vehicle was used in the said offence, the crime is registered. The vehicle is already seized. Hence, the custody of this applicant is not required. Therefore, prayed to protect him by granting anticipatory bail. 5.

The learned A.P.P. opposed the application stating that the earlier crimes which are registered against this applicant are similar. In said First Information Report, the allegations are not made that he used this vehicle for transporting illicit liquor. Considering the antecedents and allegations made against this applicant and as he fled away from the spot, the custodial interrogation of this applicant is necessary. Hence, prayed to reject the application. 6.

The allegations are made that the illicit liquor was found in the area which was banned for liquor. The applicant is the owner of the said vehicle. The persons who fled away from the spot were not identified. Only because he is the owner of the said vehicle, the First Information Report is registered.

Considering the allegations made against this applicant and as the applicant has filed an affidavit on record disclosing his antecedents, the case is made out for granting anticipatory bail. Accordingly, I pass the following order:

i] It is directed that in the event of arrest of the applicant in connection with Crime No.142/2024 registered with Police Station Chamorshi, District Gadchiroli for the offences

3 10.aba.823.25 punishable under Sections 65(a), 98 and 83 of the Maharashtra Prohibition Act, 1949, he shall be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand with one solvent surety in the like amount.

ii] The applicant shall not in any way tamper with the prosecution evidence.

iii] The applicant shall not pressurize or threaten the prosecution witnesses.

iv] The applicant shall attend the concerned police station on every Monday and Saturday between 1:00 p.m. to 2:00 p.m.

v] The applicant shall co-operate the investigation officer.

vi] Any further registration of similar crime against the applicant, the State is at liberty to file application for cancellation of bail.

The application stands disposed of.
