DATE : 13/01/2022 It is an admitted position on record that when the present petition was filed on 12.12.2019, the original proceedings before the Judicial Magistrate, Darwha in R.C.C.No. 203/2013 already stood dismissed for want of prosecution on 21.4.2017, considering which the present petition could not have been filed at all. Ms. Saware, learned counsel for the petitioner however submits that an application for condonation of delay and restoration has already been filed before the learned JMFC, which may take its own time, considering which the present petition is dismissed as infructuous, with liberty to the applicant to re-agitate the issue in case the original complaint is restored.
