Earlier in December 18, 2017 ad-interim relief was granted and was continued. However while admitting the appeal, there are no orders of continuation of interim order.

In view of that application is allowed, subject to the condition that appellant will not create any third party interest in the suit property and will deposit an amount of Rs.50,000/- or surety or bank guarantee of similar amount within a period of four weeks.

Accordingly application is disposed of SECOND APPEAL NO.745/2017 List the matter for final hearing in the week commencing from 01/08/2022.
