Heard Shri C.S. Samudra, learned counsel for the applicants/ respondent Nos. 2 & 3 and Shri S.A. Pathak, learned counsel for the petitioner.

The reason for not holding meeting of Joint Bipartite Committee for Coal Industries (JBCCI) pressed into service by the respondents cannot be accepted. Though after said direction, a statement was made before the Hon'ble Apex Court on 28.11.2016, even in that situation, on 05.06.2017, this Court granted six months time. 3.

The petitioner is opposing any extension.

We find that after suitable decision as per law is taken, the petitioner may be placed on some higher post and it may result in increase in his emoluments.

Shri Pathak, learned counsel, upon instructions, states that approximate increase per month may be Rs.8,000/- and that increase will become applicable from November 2014.

We are not inclined to go into any dispute at this

1701caw2864.17 juncture. We direct the respondents to start paying the petitioner an amount of Rs.3,000/- per month more provisionally from 01.01.2018 onwards and subject to such payment, we extend time as prayed for as last chance. JUDGE JUDGE *GS.
