The appellant-accused is seeking suspension of substantive sentence of imprisonment awarded to him by the learned Special Judge (POCSO), Malkapur in Special Case No.45 of 2020 on 08.10.2024.

The appellant is convicted for the offence under Section 354, 354-B of the Indian Penal Code (IPC) and Section 8 and 12 of the POCSO Act and sentenced to suffer Rigorous Imprisonment as well as fine as mentioned THAWRE

in the judgment. It appears that the fine amount is already paid by the appellant-accused. The learned counsel for the appellant submits that during the pendency of the trial the appellant was on bail and even after the conviction, he is released on bail.

In view of the same, the substantive sentence of imprisonment awarded by the learned Special Judge (POCSO), Malkapur, as mentioned in the operative part of the judgment, stands suspended during the pendeny of this appeal.

The appellant-accused is hereby released on P.R. Rs.25,000/- with one solvent surety in the like amount. 11.

Bail in trial Court.
