DATED : 18-10-2022 When we indicated to the learned Counsel for the petitioner Mr. Y.Y. Humne that in view of the consistent declaration of law by the Hon'ble Supreme Court, it may not be permissible for the High Court to direct registration of offence, and that the appropriate remedy may be under Section 156(3) of the Criminal Procedure Code, 1973 (Code), the learned Counsel Mr. Y.Y. Humne seeks leave to withdraw the petition with liberty to approach the learned Magistrate under Section 156(3) of the Code.
