The applicant has filed this application without any apprehension as no crime is registered against her. There is no any allegation against this applicant in the First Information Report. The applicant has filed the application before the Sessions Court on her own, only because FIR is registered against her husband.

State has also filed the reply before the Sessions Court and asked for the custody of the applicant even without going through the contents in the First Information Report. The applicant is taking the time of this Court. Instead of withdrawing the application, the applicant is seeking directions to issue notice. The learned counsel for the applicant has informed that, notices are also issued by the police and she has attended the police station. As there is Kavita
